Terms of Service

Effective date: 12 May 2026

Please read these Terms of Service ("Terms") carefully before using the Passclix Quiz platform (the "Service") operated by Passclix ("we", "our", or "us"). By accessing or using the Service — including by creating an account, taking a quiz, or administering assessments — you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age (or the minimum digital consent age in your jurisdiction) to create an account. Users under 18 must use the Service under the supervision of a parent, guardian, or educational institution that has accepted these Terms on their behalf. By registering, you represent that you meet these requirements.

2. Accounts

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must provide accurate and current information at registration and keep it up to date.
  • You must notify us immediately at legal@passclix.com if you suspect any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

3. Permitted Use

You may use the Service only for lawful educational purposes. You agree not to:

  • Copy, distribute, or disclose quiz content to others in a way that undermines the integrity of assessments.
  • Attempt to gain unauthorised access to any part of the Service, its servers, or any connected system.
  • Use automated tools (bots, scrapers, scripts) to access, extract, or interact with the Service without our prior written consent.
  • Impersonate another user, institution, or Passclix staff member.
  • Upload, post, or transmit any content that is unlawful, harmful, defamatory, or infringes the intellectual property rights of others.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.

4. Institutional Use

If you access the Service as part of an institutional licence (school, university, or training organisation), the following additional terms apply:

  • The institution's administrators are responsible for configuring subjects, quizzes, and user roles appropriately.
  • The institution is responsible for obtaining all necessary consents from students (and parents or guardians where required by law) before enrolling them on the Service.
  • Administrators must not use the Service to collect data beyond what is reasonably necessary for educational assessment.

5. Intellectual Property

All software, design, text, graphics, and other content comprising the Service — except for content you or your institution create — is owned by or licensed to Passclix and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended educational purpose only.

Content you create within the Service (e.g. quiz questions uploaded by an administrator) remains your intellectual property. By uploading content you grant us a limited licence to store, display, and process that content solely for the purpose of operating the Service.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Quiz results and performance data are provided for informational and educational purposes only. They do not constitute official academic qualifications or certifications unless explicitly stated.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PASSCLIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Passclix and its affiliates, officers, and employees from any claim, liability, damage, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or for any other legitimate operational reason. You may close your account at any time by contacting us. On termination, your right to use the Service ceases immediately. Sections 5, 7, 8, 9, 11, and 12 survive termination.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria (or, for users in the European Union, the laws of your country of residence to the extent required by applicable law). Any dispute arising out of or relating to these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts located in Lagos, Nigeria, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

12. Changes to These Terms

We may revise these Terms from time to time. We will post the updated version on this page with a new effective date and, for material changes, notify you by email or a prominent notice within the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
